HUGE WIN FOR GUN OWNERS IN CALIFORNIA

Or should we have titled this, "Huge Win for Constitutional Rights or Individual Rights"? Because, as you know, the NRA isn't just fighting for Gun Owners, it essentially by default is fighting for every Constitutional right. 

Anyway fellow Patriot - we won one. And we won it from a judge in California where we have said the Revolution from the Right will likely have to begin because the revolution usually starts where the rights of individuals is being suppressed or regulated or denied the most, where due process is essentially eliminated by the State, where politics of one party go unchecked by any other party. That, my friends, is California today.  

Everyone in the USA knows that California's insane liberal nutjob lawmakers have been chipping away at the 2nd Amendment for a long time by passing one regulation or law after another in rapid fire succession. Recently, the laws and regulations were coming so fast and furious that even legal experts in the state, the NRA, the ATF, the California Rifle and Pistol Association, the gun store owners that are licensed to sell guns in CA by the ATF - NONE of them could give you a straight answer to any number of simple questions related to owning a gun or buying ammo in CA. That is how ridiculous and insane it has become in the state of CA. Even those people in charge of enforcing the laws, and the people in the business of selling guns, can't answer your questions about the laws in California because there are too many changes, too many restrictions, too many contradictions between the new laws  and regulations, and too many opinions as to which law prevails, etc. On top of that, half the restrictions they've put in place, like the registration of ammunition purchases, can't even occur because the state itself - who passed the law - has failed to set up the infrastructure to actually allow people to apply to become licensed ammunition dealers! It missed the deadline of July 1 2017 for that. So we're about to have a law on the books and nobody will be able to comply, effectively making everyone that purchases ammunition in the State a criminal due to the fact that the state says you have to have filed certain applications as an ammo seller, have to have a background check to buy ammo - and yet there is NO infrastructure in place for either seller or buyer to comply! It's absurd. Maybe that's the result they want. Yes, this is insane, but that is California. For some time now we have said that "California = FUBAR", and it sure is in this case.

But along comes this case called Duncan v Becerra. Virginia Duncan et al are regular people guys that own large capacity magazines, are law abiding citizens, and Duncan's buddies on the suit are former 22 year Marines, etc. Stand up people. Xavier Becerra is the new liberal nutjob AG in CA who took that place of liberal nutjob Kamala Harris who is now embarrassing the State of California every day on Capitol Hill as the Senator that took crazy Barbara Boxers job recently when she retired. All a bunch of San Francisco liberal nuts, all of them. Why this state is run by nuts from SF is beyond me. Why can't we get a Senator from Stockton or Lodi where real people live and work... 

Anyway, the suit by Duncan was to basically get a temporary ruling saying that the enforcement of the 'large capacity magazine law - a new law in CA - is unconstitutional. The new law stated that if you even possessed a magazine over 10 rounds, you were breaking the law. This means that people that are otherwise abiding by the law, if they accidentally left one of these magazines in their garage, or in a bag, or in a closet - would be criminals. Duncan and her buddies sued the Attorney General for allowing and promoting the passage of an unconstitutional law. The wording in the suit is some of the best second amendment argument wording I've read. It's not a complete overturning of the law, but it does put a stop to confiscation efforts of the state which we predicted some time ago will be a big reason why conservatives revolt against the California state government in the future. IN other words, its a start - something to build upon. A case that can be referenced in other cases. 

So we won one small victory here. The California judge granted their request for an injunction against this stupid law on the basis of the arguments made, which stood fundamentally on 2nd Amendment Constitutional grounds AND on statistics provided by the NRA-ILA and others showing that there are no FACTS presented by the AG that this regulation does anything to reduce crime or stop criminals or stop mass shootings. The second amendment argument states that when the government makes compliance with the law so complicated that the average man or woman can't understand them, then they are unconstitutional. We hope that similar suits will, one by one, begin to dismantle the web of complex and unconstitutional laws jammed down the throats of Californians over the past years. It is the only way, currently, to stop an unchecked Democrat Party run state government that is raising taxes, adding regulations, and removing individual rights at an alarming rate.   

Liberals in CA have done a good job of brainwashing a lot of CA residents into believing that nobody except law enforcement needs a gun. They have passed law after law and regulation after regulation surrounding the gun owner with such a complex web of laws and restrictions that no reasonable or average person can either keep track of all the legislation or understand it. Even the representative of the AG's office can't answer questions about what the laws actually are! The liberals contention that these laws result in a safer state are absolutely NOT supported by any facts whatsoever, but yet they  continue to get away with passing them because the average liberal in California doesn't ask for evidence that gun restrictions actually work! The just vote on emotions and ignorance. The facts present quite the opposite case. The laws have no impact on crime since the majority of crimes committed with guns are committed by criminals who - SURPRISE - don't care about laws or restrictions. Duh. 

We've learned time and time again that more gun laws don't prevent violence or mass shootings. Criminals and sick individuals planning crimes and mass shootings don't read the law books on what kind of magazines they can use. Worse, these liberals have convinced people that a "gun free zone" is safer, when what we've learned from Paris and San Bernardino is the exact opposite. Gun Free Zones KILL!!! They are the modern day killing fields of our time. The bad guys pick these locations on purpose so they won't encounter resistance - someone shooting back! And we learned from the shooting in DC recently that, according to a person that was there - being shot at - the only reason that every person on that softball field (where Steve Scalise was shot) wasn't murdered that day is because there was a person with a gun there that shot back and gave the majority of people there an opportunity to get to cover. Having trained people around with guns would have prevented 120 people from dying in the Paris theatre. Maybe the thugs would have got 20 people, but not 120. The Gun Free Zone was the reason there was a massacre there and nobody - no liberal or anyone else - can bullshit us about that. 

The liberals pass their laws with slick con job marketing, using marketing-friendly names like "The Safety for All Act" and other nonsense that sells, but is not about safety at all, but about effectively eliminating one of our Constitutional rights. But supposedly its for our own safety. Remember in the movie Knight and Day? Remember what happens to people that the government agents say "We're going to take you to a place where you'll be safe and secure"? What that really meant was that those people weren't ever going to be heard from again. That's what it's like in CA. They say one thing that sounds good, but in reality, what they're doing is worse than bad. Remember, when a government official says he's doing this for your own good or your own safety, it's probably a lie - it's not for your own good and it's not for your safety at all. It's to further some agenda, and your well being is almost never on their agenda, trust me. What they're doing in this case is taking your rights, which means eventually they can take your property, incarcerate you without due process, and eventually worse. Think that's over the top? Well, the attorney that crafted this lawsuit against the idiot liberal AG Becerra and the state of California wrote something in his suit that you have to read, so I have copied it here:

"All too many of the other great tragedies of history – Stalin’s atrocities, the killing fields of Cambodia, the Holocaust, to name but a few – were perpetrated by armed troops against unarmed populations. Many could well have been avoided or mitigated, had the perpetrators known their intended victims were equipped with a rifle and twenty bullets apiece, as the Militia Act required here. If a few hundred Jewish fighters in the Warsaw Ghetto could hold off the Wehrmacht for almost a month with only a handful of weapons, six million Jews armed with rifles could not so easily have been herded into cattle cars.

My excellent colleagues have forgotten these bitter lessons of history. The prospect of tyranny may not grab the headlines the way vivid stories of gun crime routinely do. But few saw the Third Reich coming until it was too late. The Second Amendment is a doomsday provision, one designed for those exceptionally rare circumstances where all other rights have failed where the government refuses to stand for reelection and silences those who protest; where courts have lost the courage to oppose, or can find no one to enforce their decrees. However improbable these contingencies may seem today, facing them unprepared is a mistake a free people get to make only once.

Fortunately, the Framers were wise enough to entrench the right of the people to keep and bear arms within our constitutional structure. The purpose and importance of that right was still fresh in their minds, and they spelled it out clearly so it would not be forgotten." - Excerpt from Duncan v Becerra, 2017. 

I hope that this case starts the ball rolling and sets a precedent of overturning many of the draconian unconstitutional laws that the nutjobs in CA have passed which are effectively making criminals out of law abiding citizens, that this case can be the beginning of the "taking back" of the state of California, which has for too long been in the hands of the liberal left wing, run by people that are ignorant, who don't care about your rights, who are probably in some cases legitimately "out to lunch" mentally. Nancy Pelosi, Maxine Waters? Need I say more? 

Gun control is not about safety or guns, it's about getting people to submit to the authority and rule of the government. It's about SUBMISSION. That's why it's so scary. Our founding fathers wanted us to have a well armed citizenry because THEY KNEW from first hand experience how the government can become oppressive, over reaching, intrusive and begin to take, take, take. Take your money. Take your rights. Take your land. California is a state run by TAKERS. When is the last time you heard of a politician in California talk about CUTTING taxes? I can't remember that far back and I'm over 50 years old.
