Gorsuch Will Protect Second Amendment
Brilliant, thoughtful, human, wicked smart, eloquent, and highly qualified to sit on the highest appellate court in the land, Neil Gorsuch has been on full display before the Senate confirmation committee. He has been respectful of the insane attempts of the Democrats on the panel - including of course Diane Feinstein from - you guessed it - California - who has taken every email that Gorsuch has written since his days as an attorney and tried, unsuccessfully, to make things he wrote as an attorney for clients as if they were his personal beliefs, when in fact, all they were was his arguments on behalf of his clients at the time. Democrats attempts are weak and will eventually be found fruitless. Hundreds of Gorsuch's Harvard classmates, liberal and conservative, from all walks of life, have endorsed him in writing and had their endorsement entered into the record on his behalf during the Senate hearing.
Judges are poor legislators said Gorsuch. So they shouldn't legislate. They shouldn't "interpret" the law. They should APPLY the law, even if they don't like the law, even if the subject is a sympathetic one and the ruling has to go against himn. The court can then say to legislators, "You don't like my ruling, then change the law - that's your job, not mine."
The Senate hearing showed us all how talented and right this man is for the job. In one of his most powerful statements, he said, "It cannot be that the US Constitution is any less protective of the peoples rights today than they were when it was drafted 200 years ago." Democrats and anti-gun lobby is big on saying that in our new, advanced culture, we don't need guns the way we did when the Second Amendment was written. They are big on saying that in our civilized society, we have police and Sheriff's and all manner of law enforcement, therefore, there is no need for weapons in the hands of the average person. This thinking is purely wrong.
People are but a heartbeat away from being savages, even in what appears to be a civilized society. Take away food, clean water, fuel, or electricity for 48 hours and see what happens. See how civilized people remain. See how in civilized Paris, France, people arrogantly believed that having a "no gun zone" was the same as making is safe...and then 120 people were gunned down like sheep in a theatre in that "safe" zone in a matter of minutes.
Finally, the real danger foreseen by our Founding Fathers wasn't each other as potentially savage humans, it was the potential for a government to become so powerful that they stripped people of their rights. The first right to go would be the right to bear arms, second would be the right to free speech, third would be the right to due process under the law, fourth would be the right not to have your home invaded by government police, fifth would be the right to own private property, sixth would be the right to peaceably assemble, seventh would be the right to worship however you choose, and on and on and on. This is why the Founders stated so clearly that the Second Amendment "shall not be infringed upon". The Second Amendment DOESN"T say "Shall not be infringed upon until we consider ourselves above savagery", or "until we think we're so civilized that we don't need arms". It really doesn't even say we should be limited in what KIND of gun we own. If I have a ranch in Texas and I want to put a minigun that fires 9,000 round per minute on my property to protect me and my family from an intrusive government or other savage humans that want my water or my food, then I should actually be allowed to have it!
Gorsuch's statements about the Constitution gives us great comfort that our Second Amendment Right will be upheld with him on the bench. Is it possible that he will go along with the concept that a fully automatic machine gun, clearly a weapon of war, may be restricted from use or purchase or ownership by the average citizen? Sure, that is possible. But we believe that everything else will be off limits. AR-15's are not weapons of war. They are not fully automatic. They are not used by the military. They LOOK like military weapons, but they are not. We believe that Neil Gorsuch knows the difference and will uphold the Second Amendment and allow people to own these and other weapons that places like California are trying to outlaw. We believe that any restrictions that try to circumvent the Second Amendment, such as ammunition restrictions, will be viewed as simply an attempt to limit the rights of citizens under the Second Amendment and be overturned.
The battleground is going to be California and it will take place at the Supreme Court level and EVEN THEN California will ignore the Court and keep trying to push its anti-gun agenda and jam unconstitutional laws down the throats of its citizens. The NRA and its affiliates are gearing up for the battle to eliminate "end around" regulations, bans on certain types of weapons, limitations on ammunition purchases, and the establishment of "Watch Lists' of people buying ammunition in certain amounts and ammunition background checks. California went over the top in 2016 with a plethora of unconstitutional laws that are now going into effect and being enforced. These laws do nothing to stop criminals from obtaining guns and ammunition illegally and using them to harm others. All they do is make criminals out of what were, up until the laws was passed, law abiding patriotic citizens. California laws are insane, wrong-headed, and not a solution to crime of any kind. They are a Democrat driven solution designed to eventually remove all guns from our society, which is the first step that HAS TO HAPPEN in order for an oppressive regime to take control of every aspect of your lives.
